Este trabajo intenta analizar la concepción, naturaleza jurídica y garantía de los derechos económicos, sociales y culturales, en América Latina, así como las condiciones y medidas que pueden contribuir a su efectividad. Presenta también una propuesta de indicadores que pueden utilizarse en la supervisión de la efectividad de esos derechos y de la protección que ellos han alcanzado, proporcionando información sobre la situación latinoamericana y caribeña actual.

The demonstrations of monks in Tibet and Myanmar (Burma) in recent times as well as the age-old conflict between a predominantly Buddhist population and a Hindu minority in Sri Lanka raise the question of how the issues of human rights and Buddhism are related. The question applies both to the violation of basic rights in Buddhist countries and to the defence of those rights which are well-grounded in Buddhist teachings. The volume provides academic essays that reflect this up to now (...) rather neglected issue from the point of view of the three main Buddhist traditions, Theravada, Mahayana and Vajrayana. The received view holds that there is a significant divide between full-blown representational states and so called ‘detectors’, which are mechanisms set off by specific stimuli that trigger a particular effect. The main goal of this paper is to defend the idea that many detectors are genuine representations, a view that I call ‘Strong Liberal Representationalism’. More precisely, I argue that ascribing semantic properties to them contributes to an explanation of behavior, guides research in useful ways and can accommodate misrepresentation.

Informational theories of semantic content have been recently gaining prominence in the debate on the notion of mental representation. In this paper we examine new-wave informational theories which have a special focus on cognitive science. In particular, we argue that these theories face four important difficulties: they do not fully solve the problem of error, fall prey to the wrong distality attribution problem, have serious difficulties accounting for ambiguous and redundant representations and fail to deliver a metasemantic theory of representation. Furthermore, we argue that these difficulties derive from their exclusive reliance on the notion of information, so we suggest that pure informational accounts should be complemented with functional approaches. The debate on the notion of function has been historically dominated by dispositional and etiological accounts, but recently a third contender has gained prominence: the organizational account. This original theory of function is intended to offer an alternative account based on the notion of self-maintaining system. However, there is a set of cases where organizational accounts seem to generate counterintuitive results. These cases involve cross-generational traits, that is, traits that do not contribute in any relevant way to the self-maintenance of (...) the organism carrying them, but instead have very important effects on organisms that belong to the next generation. We argue that any plausible solution to the problem of cross-generational traits shows that the organizational account just is a version of the etiological theory and, furthermore, that it does not provide any substantive advantage over standard etiological theories of function. Data are lacking with regard to participants' perspectives on return of genetic research results to relatives, including after the participant's death. This paper reports descriptive results from 3,630 survey respondents: 464 participants in a pancreatic cancer biobank, 1,439 family registry participants, and 1,727 healthy individuals. Our findings indicate that most participants would feel obligated to share their results with blood relatives while alive and would want results to be shared with relatives after their death.

Naturalistic theories of representation seek to specify the conditions that must be met for an entity to represent another entity. Although these approaches have been relatively successful in certain areas, such as communication theory or genetics, many doubt that they can be employed to naturalize complex cognitive representations. In this essay I identify some of the difficulties for developing a teleosemantic theory of cognitive representations and provide a strategy for accommodating them: to look into models of signaling in evolutionary game (...) theory. I show how these models can be used to formulate teleosemantics and expand it in new directions. (shrink)

The idea that only complex brains can possess genuine representations is an important element in mainstream philosophical thinking. An alternative view, which I label ‘liberal representationalism’, holds that we should accept the existence of many more full-blown representations, from activity in retinal ganglion cells to the neural states produced by innate releasing mechanisms in cognitively unsophisticated organisms. A promising way of supporting liberal representationalism is to show it to be a consequence of our best naturalistic theories of representation. While Smith's position is not simple or evident, the articles shows that Smith's thesis affirms the existence of consequential moral luck based on the impartial spectator. It does so by highlighting the methodic meaning of his procedure and analyzing certain key issues, such as the character the appeal to nature and the teleological justifications. Four structural moments are distinguished and it is argued that only in the latter is his position decided. (shrink)

The indeterminacy problem is one of the most prominent objections against naturalistic theories of content. In this essay I present this difficulty and argue that extant accounts are unable to solve it. Then, I develop a particular version of teleosemantics, which I call ’explanation-based teleosemantics’, and show how this outstanding problem can be addressed within the framework of a powerful naturalistic theory.

En él, además de realizar algunas correcciones y estructurar la obra de forma más manejable para el lector, se ha encargado del estudio preliminar el profesor Jerónimo Molina, como ya hiciera con otras obras del mismo autor, Teoría y sistema de las formas políticas e Introducción al Derecho político actual, hace unos pocos años. En esta introducción, se nos ofrece (...) un recorrido biográfico, intelectual y político por Francisco Javier Conde, sencillo, directo y profundo. Propio de quien tiene un riguroso conocimiento del autor y de su obra. Con su lectura conseguiremos enmarcar correctamente este libro en la trayectoria vital e intelectual de Conde, entre la actitud intelectual del realismo político, el fracaso en la vida de actividad política y el olvido arrastrado hasta casi nuestros días. Y digo casi, porque, según lo que hemos dicho, no son pocos los que honran a Conde y su trabajo intelectual, de gran mérito. The goal of this essay is to put forward an original theory of artifact function, which takes on board the results of the debate on the notion of biological function and also accommodates the distinctive aspects of artifacts. More precisely, the paper develops and defends the Dual-Aspect Theory, which is a monist account according to which an artifact’s function depends on intentional and reproductive aspects. It is argued that this approach meets a set of theoretical and meta-theoretical desiderata and is (...) superior to alternative views. (shrink)

Street’s (Philos Stud 127(1):109–166, 2006) Darwinian Dilemma purports to show that evolutionary considerations are in tension with realist theories of value, which include moral realism. According to this argument, moral realism can only be defended by assuming an implausible tracking relation between moral attitudes and moral facts. In this essay, I argue that this tracking relation is not as implausible as most people have assumed by showing that the three main objections against it are flawed. Since this is a key (...) premise in the reasoning, I conclude that the Darwinian Dilemma against moral realism can be resisted. (shrink)

Deception has recently received a significant amount of attention. One of main reasons is that it lies at the intersection of various areas of research, such as the evolution of cooperation, animal communication, ethics or epistemology. This essay focuses on the biological approach to deception and argues that standard definitions put forward by most biologists and philosophers are inadequate. We provide a functional account of deception which solves the problems of extant accounts in virtue of two characteristics: deceptive states have (...) the function of causing a misinformative states and they do not necessarily provide direct benefits to the deceivers and losses to the targets. One of the main tenets of current teleosemantic theories is that simple representations are Pushmi-Pullyu states, i.e. they carry descriptive and imperative content at the same time. In the paper I present an argument that shows that if we add this claim to the core tenets of teleosemantics, then (1) it entails that, necessarily, all representations are Pushmi-Pullyu states and (2) it undermines one of the main motivations for the Pushmi-Pullyu account.

The goal of this essay is to assess the Selected-Effects Etiological Theory of biological function, according to which a trait has a function F if and only if it has been selected for F. First, I argue that this approach should be understood as describing the paradigm case of functions, rather than as establishing necessary and sufficient conditions for function possession. I contend that, interpreted in this way, the selected-effects approach can explain two central properties of functions and can satisfactorily (...) address some recent counterexamples. This reading, however, shows that there is only a partial overlap between biological functions and selected effects, so the former cannot be reduced to the latter. Finally, I maintain that this result is still compatible with a naturalistic theory of function that appeals to some evolutionary process. (shrink)

In this paper I discuss a recent theory on functions called Organizational Account. This theory seeks to provide a new definition of function that overcomes the distinction between etiological and dispositional accounts and that could be used in biology as well as in technology. I present a definition of function that I think captures the intuitions of Organizational Accounts and consider several objections.

This study investigates the effects on organization’s financial performances of, first, the extent to which the organizations are involved in controversial business activities, and second, their level of social performance. These companies can be considered non-socially responsible given the harmful nature of the activities they are involved in. Managers of these companies may still have incentives to pursue socially responsible actions if they believe that engaging on those actions will help them to achieve legitimacy and improve investors’ perception about them. (...) We develop a comprehensive methodology to investigate these corporate social performance (CSP)-related effects in a complex but specific setting. To this end, we analyze a sample of 202 US firms for the period 2005–2008 using a novel method in this area: partial least squares. Our results indicate that, contrary to the general findings in prior literature, companies involved in controversial business activities which engage in CSP do not directly reduce the negative perception that stakeholders have about them. Instead, we found evidence of a positive mediation effect of CSP on financial market-based performance through innovation. (shrink)

Mendelovici (forthcoming) has recently argued that (1) tracking theories of mental representation (including teleosemantics) are incompatible with the possibility of reliable misrepresentation and that (2) this is an important difficulty for them. Furthermore, she argues that this problem commits teleosemantics to an unjustified a priori rejection of color eliminativism. In this paper I argue that (1) teleosemantics can accommodate most cases of reliable misrepresentation, (2) those cases the theory fails to account for are not objectionable and (3) teleosemantics is not (...) committed to any problematic view on the color realism-antirealism debate. Although the definition of ‘signal’ has been controversial for some time within the life sciences, current approaches seem to be converging toward a common analysis. This powerful framework can satisfactorily accommodate many cases of signaling and captures some of its main features. This paper argues, however, that there is a central feature of signals that so far has been largely overlooked: its special causal role. More precisely, I argue that a distinctive feature of signals is that they are minimal causes. (...) There has recently been an explosion of formal models of signalling, which have been developed to learn about different aspects of meaning. This paper discusses whether that success can also be used to provide an original naturalistic theory of meaning in terms of information or some related notion. In particular, it argues that, although these models can teach us a lot about different aspects of content, at the moment they fail to support the idea that meaning just is some kind (...) of information. As an alternative, I suggest a more modest approach to the relationship between informational notions used in models and semantic properties in the natural world. (shrink)

Gene editing techniques, such as CRISPR, are being heralded as powerful new tools for delivering agricultural products and foods with a variety of beneficial traits quickly, easily, and cheaply. Proponents are concerned, however, about whether the public will accept the new technology and that excessive regulatory oversight could limit the technology’s potential. In this paper, we draw on the sociotechnical imaginaries literature to examine how proponents are imagining the potential benefits and risks of gene editing technologies within agriculture. We derive (...) our data from a content analysis of public comments submitted to the Food and Drug Administration’s 2017 docket titled “Genome Editing in New Plant Varieties Used for Food.” Our sample frame consists of 26 comments representing 30 agriculture and biotech companies, organizations, and trade associations. Our findings reveal three key sociotechnical imaginaries, including that gene editing technologies in agriculture: are not GMO but instead equivalent to traditional plant breeding; have the potential to usher in a new Green Revolution; and could facilitate the democratization of agricultural biotechnologies. We argue that forming and projecting these collective interpretations of the potential of gene editing technologies for crops and foods plays an important role in efforts by proponents to influence regulatory oversight, modes of governance, and build public acceptance. This research contributes to calls by science and technology studies scholars to investigate emergent concerns and imaginaries for novel technoscientific advances to help inform upstream models of public engagement and governance decisions. The purpose of this study is exposition on the themes of method and mysticism in the work of Simone Weil. Nearly a decade before the onset of her first mystical experience, Weil developed a method to be rigorously applied in daily philosophical reflection. She outlines this method in her dissertation on Descartes (1929-1930). I examine the question of how Weil applied method to philosophical reflection on her mystical experiences (onset 1938-1939). I analyze Weil’s mystical experiences as a type of transformative (...) experience in L. A. Paul’s strict sense of the term. On Paul’s view, an experience is transformative if it is both epistemically and personally transformative. An experience is epistemically transformative if the only way to know what it is like to have it is to have it yourself. An experience is personally transformative if it changes your point of view, including your core preferences (Paul, 2014). I present a thought experiment and textual evidence to motivate the claim that Weil’s mystical experiences meet Paul’s conditions for transformative experience. I then propose two epistemological facts that can be revealed by philosophical reflection on mystical experience. First, it is possible to read meaning erroneously in the appearances of things. Second, it is possible to come to hold to the certainty of a conviction for reasons that elude the intellect. My findings suggest that Weil’s late views on philosophy accommodate these two epistemological constraints, thereby demonstrating a possible connection between Weil’s mystical experiences and her mature views on the nature, scope, and proper method of philosophy. However, my preliminary findings also suggest that Weil’s early work on method may have anticipated these epistemological obstacles prior to the onset of her first mystical experience. Thus, further exposition of Weil’s method is needed to support or elucidate the claim (Rozelle-Stone and Davis, 2021) that Weil’s epistemology underwent significant changes because of her mystical experiences. The perception of sensory effects generated by one’s own actions is typically attenuated compared to the same effects generated externally. However, it is unclear whether this specifically relates to self-generation. Recent studies showed that sensory attenuation mainly relies on action preparation, not actual action execution. Hence, an attenuation of sensory effects generated by another person might occur if these actions can be anticipated and thus be prepared for.Here, we compared the perceived loudness of sounds generated by one’s own actions and (...) actions of another person that either could or could not be anticipated. We found an attenuation of the perceived loudness for self- as compared to other-generated sounds. This difference was independent of whether the sound-eliciting actions of the other person could be anticipated or not. Thus, sensory attenuation seems to be specifically tied to self-generation instead of being a secondary effect of agent-independent preparation for an upcoming action. (shrink)

Ethological theories usually attribute semantic content to animal signals. To account for this fact, many biologists and philosophers appeal to some version of teleosemantics. However, this picture has recently came under attack: while mainstream teleosemantics assumes that representational systems must cooperate, some biologists and philosophers argue that in certain cases signaling can evolve within systems lacking common interest. In this paper I defend the standard view from this objection.

In a series of papers, Bence Nanay has recently put forward and defended a new theory of function, which he calls the ‘Modal Theory of Function’. In this article, I critically address this theory and argue that it fails to fulfill some key desiderata that a satisfactory theory of function must comply with. As a result, I conclude that, whatever property Nanay’s notion of function refers to, it is not the property having the function that is standardly attributed in science.

In this essay I introduce the question of artifactual functions in the context of the recent debate on the notion of function. I discuss some of the desiderata a satisfactory account should fulfill and compare them to the desiderata for a theory of biological functions. Finally, within this general framework, I briefly present the three papers included in this volume.

Recent research on bacteria and other microorganisms has provided interesting insights into the nature of life, cooperation, evolution, individuality or species. In this paper, I focus on the capacity of bacteria to produce molecules that are usually classified as ’signals’ and I defend two claims. First, I argue that certain interactions between bacteria should actually qualify as genuine forms of communication. Second, I use this case study to revise our general theories of signaling. Among other things, I argue that a (...) plausible requirement for a state to qualify as a signal is that it is a minimal cause. (shrink)

We explore the contribution made by oscillatory, synchronous neural activity to representation in the brain. We closely examine six prominent examples of brain function in which neural oscillations play a central role, and identify two levels of involvement that these oscillations take in the emergence of representations: enabling (when oscillations help to establish a communication channel between sender and receiver, or are causally involved in triggering a representation) and properly representational (when oscillations are a constitutive part of the representation). We (...) show that even an idealized informational sender–receiver account of representation makes the representational status of oscillations a non-trivial matter, which depends on rather minute empirical details. We defend the moral and legal right to secede in accordance with plebiscitary theory. Our paper has three main goals. First, by offering a schematic characterization of plebiscitary theory, the main arguments in its favour (and the main objections to them), we contribute to clarify the structure of this complex debate. Second, we stress the point that, if the moral right to secede is established, the resistance for its inclusion into positive law is unjustified. Finally, by addressing old and new (...) objections to plebiscitary theory, we hope to make a compelling case for a wider recognition of secessionist rights. (shrink)

Given the crucial role of the mass media in influencing public discourse, this study examines the discourses around climate change within the Brazilian press, covering the time period of 2003–2013. Survey evidence has shown that Brazilians’ degree of concern about climate change is higher than almost anywhere else, with nine out of 10 Brazilians considering climate change a serious problem. The primary purpose of this study is to investigate how the press engendered Brazilians’ striking level of climate change concern, with (...) special attention to how the discourse developed over time. To this end, I undertake a corpus-assisted discourse analysis to examine the most dominant linguistic patterns in the discourse, presenting evidence on an unprecedented scale and with considerable depth. The corpus consists of 19,686 newspaper texts published by 12 Brazilian broadsheet papers. The results are interpreted in the light of available opinion polls on the public’s perception of climate change as well as Brazil’s national context and environmental governance. (shrink)

This article turns to Hannah Arendt's Eichmann in Jerusalem in order to illustrate the difficulties involved in approaching the (formerly) metaphysical concept of evil as a secular phenomenon. It asks how the advocate of plurality, natality and forgiveness could also vouch for the death sentence of Eichmann based on a rhetoric of retribution and revenge. It then shows that Arendt's surprisingly consistent view of evil is based on a quasi-ontological understanding of the human condition that allowed her to negate Eichmann's (...) humanity. Rather than simply unmasking a metaphysical account in disguise, however, the article develops an alternative perspective that emerges from the conversation between Arendt and Jaspers. It argues that Jaspers's interpretation of Kant offers a way to defend the idea of secular evil and judge Eichmann on the basis of his thoughtlessness. (shrink)
